All products offered by KEVIN MANAND - ENTERPIX are described and represented as accurately, completely and specifically as possible. The promotions and the prices are valid on the day they are proposed on our site. KEVIN MANAND - ENTERPIX declines all responsibility in the event that, despite its best efforts, an error should find its way into its products catalogue.

KEVIN MANAND - ENTERPIX may not, under any circumstances, be held liable for the erroneous or unjustified use that the purchaser might make of the items that he acquired on the site, or for possible material and tangible damage caused to third parties by an erroneous and/or illegal use of the items acquired on this same site.

3. Our prices

All our prices are in Euros and include any ecotaxes. For the countries of the European Union (EU) the prices are exclusive of VAT. The prices do not include the transport costs, which vary as a function of the country of destination. Transport is free of charge for purchases higher than 300 €. 4. The order

The sale contract between the purchaser and KEVIN MANAND - ENTERPIX is deemed valid once KEVIN MANAND - ENTERPIX receives confirmation of the order on its website. KEVIN MANAND - ENTERPIX will systematically send a confirmation e-mail to the purchaser. KEVIN MANAND - ENTERPIX reserves the right to refuse an order or to subject it to supplementary conditions. Any purchaser who places an order on the site declares that he is over 18 years of age and is responsible for his act of purchase.

5. License to the users

KEVIN MANAND - ENTERPIX grants to the users, under the suspensive condition of prior payment of the sums which are owed to it, a personal right, non-exclusive and non-transferable, to use the images downloaded from its site, solely for the following purposes : they can be copied onto a hard disk and manipulated there solely for the uses enumerated below :
they can be incorporated into publications with format smaller than 1250 cm2, of which the user-beneficiary of the use licence is the publisher or designer, for his own account or that of his customers, such as leaflets, catalogues, folders, invitations, greeting cards, small posters, flyers, activity reports, corporate press, specialised press, general information press or institutional press, internet site and CD-ROM or any other electronic or magnetic medium or process replacing these in the future, as long as the screen resolution of the image is equal to or less than 72 DPI.

Uses of the images on the internet, CD-ROM or other electronic or magnetic medium capable of being downloaded or reused by third parties, in any way, are therefore excluded from the licence. In certain cases and on written request, KEVIN MANAND - ENTERPIX gives to the users an access to the previews of its images without the copyright logos. These previews are allowed to be recorded or received in order to perform layout tests and create models, and this under no circumstances presupposes that the rights were acquired. The user undertakes to restrict himself solely to these uses and to delete any copy of these previews from the hard disk or from any other medium once the tests are completed.

6. Uses not covered by the licence

Uses of the images of KEVIN MANAND - ENTERPIX not covered by the licence described in article 5 must form the object of a specific written agreement concluded in advance.
In the event of a use which is not authorised in article 5, and without prejudice to the provisions foreseeing the end of the licence, notably in the event of unauthorised use of the images of KEVIN MANAND - ENTERPIX, an indemnity corresponding to five times the basic tariff of KEVIN MANAND - ENTERPIX will be owed to the latter.

7. Intellectual property

All of the rights relating to the images downloaded from the ENTERPIX.BE site are the property of KEVIN MANAND - ENTERPIX, rue des artisans 17/2, 6791 Athus, Belgium, which authorises the use of said images solely within the limits defined in the present general conditions or in any written special conditions.

8. Term

• A. The term of the use licence conferred in article 5 for "online" purchases with payment by card: this licence has an unlimited term, provided that the size of the publications of the images concerned is less than or equal to the size of the file downloaded without redimensioning, and in any event is less than 1,250 cm2. Nevertheless, this licence will be terminated notably in the event of publication of the image with a size that does not correspond to that described above.
• B. Early termination of the licences : in any case, the use licences will be terminated early in the event of failure to respect the present general conditions or use of the images of KEVIN MANAND - ENTERPIX for purposes other than those described in the licence as well as in the event of transfer, notably by sub-licence, of the use rights granted.
• C. Effects of the end of the licence : At the end of the licence, and notably in the event of its early termination, all use of the images of KEVIN MANAND - ENTERPIX must be immediately stopped and all of the copies of the images of KEVIN MANAND - ENTERPIX must be deleted from every medium in your possession.

9. Rights of third parties

The use of an image or of a document is always capable of infringing the rights of third parties, and notably the persons represented or the holders of rights, notably on the objects, logos, buildings or brands represented. It is therefore incumbent upon you to first obtain from the persons represented (or the holders of rights on the goods represented) or from KEVIN MANAND - ENTERPIX confirmation of their authorisation as to the planned use of the image concerned. Our images representing identifiable persons, notably ones whose last name and/or first name is mentioned in the caption (or goods on which rights are held by third parties) thus cannot be used for purely illustrative purposes without special authorisation.

10. Responsibility

The co-contracting party of KEVIN MANAND - ENTERPIX is, vis-à-vis the latter, responsible for the uses of the images of KEVIN MANAND - ENTERPIX that he downloaded and he thus guarantees, vis-à-vis KEVIN MANAND - ENTERPIX, the respect of the present general conditions by his own relations, and this without prejudice to the right of KEVIN MANAND - ENTERPIX to also raise the liability of third parties, notably in the event of unauthorised use of its images. In addition, KEVIN MANAND - ENTERPIX, which does everything in its power to offer high-quality service, may not be held liable for the consequences of possible computer malfunctions or variations in colours or form which can result from the electronic transmission of the images.

Any sum owed to KEVIN MANAND - ENTERPIX is payable in cash at its registered office or into its bank account ; any sum unpaid on the due date will ipso jure give rise to contractual interest at the rate of 10 % per year and will be increased automatically and without formal notice by 12 % in order to cover on an inclusive basis the administrative costs of KEVIN MANAND - ENTERPIX

15. Jurisdiction

Any dispute concerning the conclusion, validity, interpretation or execution of the sale contract or of the present general conditions is governed exclusively by Belgian law and falls under the exclusive jurisdiction of the courts of the district of Arlon.
